Mr. Raj Singh Niranjan & Ms. Sonia Bharaj, Advocate(s) at Trans-India Law Associates addressed the 6th Workshop & Panel Discussion on Corporate Social Responsibility (Contemporary Issues & Opportunities) on 28th & 29th November, 2014 at Asia Pacific Institute of Management, New Delhi.
Mr. Niranjan discussed about legal aspect of CSR w.r.t. the Companies Act, 2013. He informed the gathering that it is mandatory for companies with certain threshold to form a CSR Committee and spend at least 2 % profits in social activities provided by Companies Act (Schedule VII). Mr. Niranjan, further discussed Constitution & Role of CSR Committee & contents of CSR Policy along with Annual Reporting by Board of Directors.
Ms. Sonia Bharaj from the Tax Practice team of TILA discussed on tax impact of various CSR activities describing various different kind of funds and activities where tax deductions under different sections & provisions can be availed.
In the end, Mr. Niranjan concluded that CSR activities can be done through establishment or contribution to Charitable Trust, Society & Not for Profit Companies (Section 8) which are very important for our sustainable economic & social development.
